Federal Court to Trump: Your Emergency Tariff Powers Are Not Real

A federal appeals court has delivered a blunt verdict on Donald Trump’s trade policy: the emergency powers he claimed to have to impose global tariffs are not real. The court ruled his use of the International Emergency Economic Powers Act (IEEPA) for this purpose was illegal.

The judges determined that the former president’s attempt to classify the U.S. trade deficit as a national emergency was an invalid pretext to unlock the powers of the IEEPA. The ruling clarifies that the law is for genuine security crises and does not provide a “blank check” for a president to enact their own trade agenda.
